Is it illegal to for an auto dealer to sell vehicles with stripped emission controls?

It is illegal under both state and federal law to even drive a diesel vehicle that has had its’ emission controls stripped. It is certainly an unfair and deceptive act to sell such a vehicle to an unsuspecting consumer. Despite this, consumers keep calling our office to complain about having purchased used diesel trucks only to discover at some point later that the vehicle had its’ diesel particulate filter removed and or had its’ emission controls stripped.

Our office recently settled a case for a consumer who experienced this problem after purchasing from a truck dealer in the Northwest, only to discover the problem after moving out of state. Of course, the auto dealer never informed the consumer of this issue. 

If a Washington auto dealer sold you a vehicle that has had its’ diesel particulate filter removed or emission controls stripped you may be a victim of auto dealer fraud. 

Under Washington law, the dealer who sold you such a vehicle may be liable for violating the Washington Auto Dealers Act, a per se consumer protection violation. These cases require the knowledge and experience of a Washington odometer fraud lawyer to successfully resolve these matters.
